Tenant Documents Checks

The Immigration Act 2014 places new requirements for landlords and agents to ensure appropriate checks are carried out on tenants accessing private accommodation. Therefore Landlords will be required to:

  • Carry out document checks to identify if the potential tenant has the right to reside in the UK, before a tenancy is granted.
  • Keep records for a minimum of 12 months.

Potential Fines

Landlords who do not carry out appropriate checks can be fined up to £3,000.00 if the illegal tenants are residing at their property.
As a result, Tenant Find will ensure all appropriate checks are carried out to ascertain if the tenants are legally able to reside in the UK. In certain cases this will involve checking with the Home Office.

Professional Referencing

In conjunction with our partner’s rent4sure we are able to provide professional references at reduced rates. This is due to our bulk purchases and long term commitments. The referencing process can be fairly quick if the information is available to hand. However, in certain circumstances further checks are made to ensure the authencity of the applicant. The credit check will provide information and a score for the tenant establishing if they are a low, medium or high risk tenant.

Tenancy Agreement

Our tenancy agreement include detailed clauses in line with the Housing Act, which are applicable under the current legislation. Please note that this is a short hold tenancy agreement and extra clauses can be added by the landlord.

Create your own Tenancy Agreement via our App services

Tenant Find now offers a unique new App, which can be downloaded from Android or the IOS store. This App allows landlords to create a tenancy agreement on the spot. Both the landlord and tenant are able to sign the agreement using the App. Once you are happy with the agreement, the App allows you to email the agreement to yourself and the tenant. Deposit Collection & Protection

Tenant Find can collect a deposit on your behalf and register it into the Tenancy Deposit Scheme. We also generate a certificate for your tenants to prove the deposit is held legally.

Rent Guarantee & Legal Cover up to £25,000

In conjunction with rent4sure we offer Rent Guarantee cover of up to £25,000 within a year. In the event your tenants doesnot pay the policy will cover your rent. Legal cover is provided to cover you on the costs of tenant eviction if necessary.

Rent Collection

Rent is collected via standing orders or debit card system with the bank. Our database system is very productive in working out outstanding rents to ensure payments to the landlords are made on time. Once the payments are collected and reconciled with our banking systems, landlords are paid and statements are generated accordingly.

EPC Certificate

(Available nationally)

As of 9th January 2013 government legislation requires the following:

  • The seller or landlord must provide an EPC free of charge to a prospective buyer or tenant at the earliest opportunity. A copy of the EPC must also be provided to the successful buyer or the person who takes up the tenancy.
  • Estate agents and other third parties must ensure that an EPC has been commissioned before they can market a property for sale or rent. In addition, all advertisements in the commercial media* must clearly show the energy rating of the building (where available).

“Commercial media” means: Newspapers and magazines; written material produced by the seller/landlord/estate agent that describes the building being offered for sale or rent; or on the internet.

Gas Safety Certificate

As a landlord, you are responsible for the safety of your tenants. The Gas Safety (Installation and Use) Regulations 1998 deal with landlords’ duties to make sure gas appliances, fittings and flues provided for tenants are safe. Before the start of tenancy you must ensure that you have a valid Gas Safety Certificate within the last year. All appliances using gas and flues must be checked and have a certificate to ensure they are safe.

Gas Safety Certificate is provided by a Gas Safe Registered Engineer after all the safety checks are carried out and deemed safe to use.

5. Receiving offers

Each offer for rental is important. As soon as we receive an offer we will carry out our referencing checks, which includes:

  • Credit Check.
  • Working status.
  • Income Verification.
  • Previous Landlord/Agent Checks.

Once we have completed a report we will contact you to inform you of the offer and if the tenant has passed the reference checks.

6. Offer Agreed

Once you accept the offer we will do the following:

  • Collect paperwork from the tenant.
  • Prepare and obtain a signed tenancy agreements .
  • Collect the moving in payments (deposits and rent).
  • Forward the payments to the Landlord.

7. Deposit Protection

As part of the Housing Act 2004 the Government introduced tenancy deposit protection for all assured short hold tenancies (ASTs) in England and Wales where a deposit is taken. From 6th April 2007, all deposits paid under an AST should be protected within 14 calendar days of receipt by the landlord.

From 6th April 2012, deposits for all assured short hold tenancies (ASTs) in England and Wales must now be protected within 30 calendar days of receipt by the landlord, this change is as a result of the Localism Bill 2011.

8. Inventory & Schedule of Condition

This is a very important document and you must ensure this is completed correctly. It will detail the condition of the property at the time when the tenants move in. The inventory provides details of all the landlords’ belongings and if there are any defects in the property, they are noted in the schedule of condition. When the tenants move out this will be used to determine the original condition the property was let. This document is used as evidence if there are any disagreements between the landlord and tenant regarding the deposit. On the day you check the tenants in, both parties the landlord and the tenants will need to sign the inventory.

This is to ensure the property is kept in a good condition.

12. PAT Testing

Electrical appliances must “be safe” - you have a responsibility to ensure that all electrical appliances, circuits, cables, switches and fuse boards are safe and sound. There is no legal requirement to produce a certificate BUT, if the unfortunate did happen, would you be covered? A simple PAT test will ensure that all appliances left in your property are tested for earthing, continuity and soundness. All appliances are labelled. This is one way you could prove that you have taken your responsibility seriously.

13. Smoke Alarms

If your property was built after 1992 then it is a legal requirement to have a mains fitted fire alarm in your property. Minimum of one alarm to one floor is required. Landlord’s must ensure:

  • Access to escape routes is available at all times.
  • Furniture and fittings supplied are fire safe.
  • (HMO) Houses in multiple occupation properties need to have fire alarms and extinguishers..

15. Completion

Once the contract is signed by both parties and all the paperwork is in place, the landlord will arrange to release the Keys to the tenant. We will forward a copy of all the paperwork to the landlord. As part of the service we will contact the landlord after 6 months to enquire if he/she is happy to extend the contract for another 6 months. We will arrange to get all the agreements completed and sent to both parties at no cost to the landlord.

16. Check In

The check in process is where the landlord checks the tenants in at the property by taking the meter readings and explaining how the appliances at the property work. The inventory is signed by both parties.

17. Check out

On completion of the tenancy and on moving out date, the tenants meet the landlord at the property. They will then undertake the checkout process. The landlord uses the inventory & schedule of condition to determine the condition of the property, and how much deductions are required from the deposit.
